Terms & Conditions

When making your booking it is implied and accepted that you have read and understood all these booking conditions and agree to abide by them.
 
  • All bookings are made with Tide Watersports, 1 Shakespeare Road, Margate, Kent, CT9 1TY

  • No booking will be confirmed until the agreed payment is received.

  • We accept payment by bank transfer or debit or credit card.

 

CANCELLATION

The company reserves the right to cancel any course  for any reason at any time before the start of the course. In this situation participants will be offered alternative dates or a full refund. Cancellation due to situations out of the control of Tide Watersports such as wars, natural disasters, health epidemics & pandemics, may be subject to the loss of money paid where a refund is not possible.

In the event of no wind it is not possible to refund the money of the participant, instead alternative dates will be offered to reschedule.


All re-bookings will be handled directly with participants for further courses and rebooking in the event of adverse conditions.

A failure to attend a booked course will be considered a cancellation and will incur the loss of money paid.

The terms and conditions of all agreements made with Tide Watersports shall be subject to, and governed by, English law.

Courses are to be sold according to the course description and content. No course should be sold as to a level ascertained on its completion.


We are not responsible for weather and have no control over it. We make every effort to provide alternative activities and dates. This is subject to availability. Refunds are not given due to weather conditions.


All lesson vouchers and credit slips for lessons are valid for 12 months. Once expired they will not be valid.

All invoices and course payments will be made at time of booking, in advance of course commencement. Late invoices will incur a £40 fee according to UK law. Interest will be charged per month at 8% from date of late payment.

 

EQUIPMENT RENTAL 

Rental of kite equipment may be offered to ‘safely independent’ kiters who carry third party liability kitesurf insurance, unlike lessons, they accept personal liability for other people and the equipment they’re hiring.

a) we reserve the right to deny or cancel rental at any time.

b) persons not flying responsibly for themselves, others or the kit, will be issued warnings. If undesirable behaviour continues we may cancel hire with no refund at any time.

LIABILITY AND INSURANCE

Kitesurfing is a potentially dangerous activity. All participants must be aware of this and accept the risks associated with this activity. Injury arising from kitesurfing or associated activities can only be accepted if caused by negligence on the part of Tide Watersports.


It is an obligatory requirement for the participants to have valid holiday insurance & valid BKSA membership Insurance when attending a Tide Watersports coaching clinic. It is the responsibility of the client to check visa entry to a country in relation to their nationality.

Tide Watersports is under no liability whatsoever in respect of loss or damage to property or equipment, however caused, whilst on a course with Tide Watersports.

 

HEALTH & SAFETY CONSIDERATIONS


Due to the strenuous nature of kitesurfing, all participants should be physically fit. Anyone with a medical condition must seek medical advice before considering participating.

All participants should be able to swim 50m and be confident in open water.

All participants must be aged 16 or over. Under 16’s can attend specific youngsters courses at the discretion of Tide Watersports.

Course participants will not be permitted to consume alcohol or drugs prior to or during kitesurfing courses. Tide Watersports reserves the right to refuse participation to anyone considered to be under the influence of alcohol or drugs.

Tide Watersports may require any participant to leave the course if that person acts in any such manner as to endanger him/herself or any other participant.

 

DISABILITIES

Tide Watersports must be informed of any medical conditions (asthma, epilepsy,deafness etc) or any other special needs of any/all participants. Tide Watersports Ltd reserves the right to refuse a person who is at a high risk to him/herself or other participants on the course.

 

EQUIPMENT AND CLOTHING

Damage or loss to Tide Watersports' equipment caused by negligence, malicious acts or carelessness must be paid for at the time at current replacement value.
